Terms of Service

This is my current Terms of service for private commissions. a copy of this text is present on all order forms, and I will not accept orders without these terms being agreed to by the client. If you have any questions about the terms listed here, please feel free to contact me through twitter or email.

I require that all clients are over the age of 18 when placing an order.
Please do not order a commission if the payment method you are using to pay my invoice is not in your name/you are not the primary account holder, or if you are a minor attempting to order NSFW content.
1. I retain the distribution and publishing rights to my art. You are not allowed to sell or attempt to make a profit off of the commissioned artworks in any way, nor are you to claim that you made them. This includes for the use in personal or professional portfolios, crowd support platforms (Patreon/SubscribeStar/Pixiv Fanbox/etc), competitions, or any situation where you will be making monetary profit or gaining assets either digital, physical or other using the work I have created.1a. In the case where fan art has been commissioned of a character from a commercial IP or similar, I retain the right to distribute and sell the artwork. If you would prefer for the piece to remain private, a privacy fee will be required as per section 7.1b. I also retain the right to use parts or the entirety of the artworks created to advertise my services. I will refrain from editing or distorting the intention of the piece, however.1c. Your commissioned artwork, both sketches, line work and the finished piece may be posted on my Patreon alongside the finished work being available on my public social media accounts. This section is invalid if you have paid for your commission to be private.2. Do not remove my watermark or signature from commissioned works, and where possible please credit me for the artwork if you are re-uploading it to your own profile. Please see above for all of my social media links.3. Please do not edit or alter the commissioned artwork, use it as a base for a new artwork. I no longer provide source files for people to finish sketch or line commissions themselves, but if you intend on colouring a commission I have done for you please make sure to credit me as having done the initial work.4. I will maintain interaction with all clients during the process of the commission. Once the piece is completed I will not be making edits or changes without an additional cost. Regardless of if you think you are going to hurt my feelings, please let me know if something is wrong or needs to be changed no later than the lining process. There is no excuse to wait until the last moment to tell me, as I will not be proceeding with the piece until I have absolute confirmation that everything is correct before initiating the colouring stage.4a. The fee for late-stage edits will change depending on whether something has to be recoloured, relined, or if the whole composition is affected by the alteration.4b. You may not ask for a variation at the later stage of the commission in order to circumvent this fee. Variations need to be planned and accounted for from the beginning of the piece, so beyond the sketching/lining phase I will most likely decline this request.4c. If a revision is required based on inadequate or missing information from the client, a revision fee will be charged.5. Payment will need to be paid upfront for all sketch commissions - Simple and Complex commissions types can be paid half up front and half before the finished piece is sent. You may pay entirely upfront if you wish, however I do not take payment upon completion. Regardless of the amount paid, the minimum payment on orders is non-refundable unless I have not started the commission.5a. You have a maximum of one week to pay the upfront payment, unless it has been organized prior. If you do not pay the first payment within one week of the sketch being completed, then the commission will be cancelled and the sketch will repurposed.5b. I reserve the right to refuse future service if payment was not made within the time frame above, an alternate time frame negotiated, or if you do not contact me with a reasonable amount of time if there are circumstances which will stop you from being able to make payment.6. There will be no full refunds once the lining is completed and the colouring has been started, through to the end of the piece. Refunds will be negotiated based on what work has been completed.7. I retain the right to publish any artwork I complete for commissions to my social media, as well as personal and public portfolios. You can request to be kept anonymous, otherwise I will link and credit you in the description.
7a. In the situation where you would prefer for the piece to not be uploaded at all, a privacy fee will be incurred, calculated based on the total commission cost. The rates are 25% for artwork featuring original characters, and 50% for fan-art pieces.
8. The characters and ideas that are represented in the commission artwork I produce are not a reflection of my own opinions or characters - any opinions I offer during the process of commissions is based on remaining neutral and objective towards the commissioner and their order, and thus should not be taken as a reflection of my own values. Please do not assert otherwise.9. I retain the right to refuse service if the content, characters or ideas present with a commission make me uncomfortable or I disagree with them on a personal or professional level.10. If a commission is cancelled, I retain the right to repurpose and alter the sketch for use as a YCH. The original commission file will be deleted. You are not entitled to any compensation, credit or notification if this occurs.11. I will not proceed with the next steps of a piece until I have confirmation from the client that everything is correct. The time it takes to complete the artwork will thus be dependant on how quickly you are able to reply to correspondence. Any time frame that I give is a rough estimation based on my schedule at that time, however, it may take up to four weeks for a commission to be completed. If you need an order to be filled before that time, please let me know the preferred date and we can discuss it.12. You are more than welcome to ask for updates and WIP screenshots during any point of the process outside of what I provide you. I only ask for a minimum of 3 days between WIP requests or updates.13. All progress screenshots will be heavily watermarked and of low quality. Please do not request them without this, as I will not be able to comply.14. All finished pieces and progress shots will only be kept on my GDrive/HDD for the duration of the commission and a short while afterward. As such, please make sure that you are saving these files on your own, as I will not be keeping copies indefinitely and may not be able to produce the files for you if requested at a later date.15. Please refrain from issuing a chargeback before at least a month has passed with no response from me. Once the order is placed I will give you the time frame in which the piece will be finished by - any other comments I make during updates and correspondence (ex. “I will most likely have the lining completed by the end of the weekend!”) are approximations only, and do not affect the overall deadline date.15b. Though I work with a queue, I often do work for several commissions at once and prioritize whoever ordered first. This means that there may be several days without progress if I have started working on your commissions earlier while I wait for correspondence from someone before you.16. Please note that while I am completing commissions, I may still be doing or posting personal work to my social media and accounts. This does not mean I am ignoring your commission or have stopped working on it. If the completion date for your order has not yet passed, this does not make a justifiable reason for a refund.
